CITY OF PLEASANTO <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> 3'228 <br />RESI:]LUTIDN ND. <br /> <br />DECLARING INTENT TO VACATE A PORTION <br />OF THIRD STREET, NEAR MINNIE STREET, <br />BEING A PUBLIC STREET IN THE CITY OF <br />PLEASANTON, ALAMEDA COUNTY, CALIFORNIA. <br /> <br />The City Council does hereby resolve as follows: <br /> <br /> 1. That this City Council of the City of Pleasanton does <br />hereby declare its election to proceed, by its own motion, under <br />the provisions of Part 3, Division 9, being Section 8320 of <br />the Streets and Highways Code, State of California, entitled the <br />Street Vacation Act of 1941, to vacate the following described <br />public street, being a portion of Third Street, near Minney <br />Street, located in the City of Pleasanton which Js lawfully, <br />officially and cormnonly known as hereinafter set forth; to wit: <br /> <br />AS DESCRIBED IN FULL IN EXHIBIT I!A!~, <br />ATTACHED HERETO AND MADE A P.~RT HEREOF. <br /> <br /> EXCEPTING AND RESERVING THEREFROM, pursuant to the provision <br />of Scetion 8330 of the 3treets and Highways Code, the easement <br />and right at any time or from time to time to construct, maintain <br />operate, replace, remoYe, renew and enlarge l~nes of pipe, con- <br />duits, cables, wires and other convenient equipment and f~xtures <br />for the operation of cormnunication lines, electrical transmission <br />and distribution lines, natural gas lines and water lines, and <br />for incidental purposes including access to protect property from <br />all hazards in, upon and over all that portion of Third Street <br />hereinbefore abandoned. <br /> <br /> 2. Further reference is hereby made to the map or plan on <br />file in the office of said City Clerk of the City of Pleasanton <br />for particulars as to the proposed vacatSon. <br /> <br /> 3. That NOTICE IS HEREBY GIVEN that there will be a hearing <br />for all persons interested in or objecting to the proposed va- <br />cation at the time and place as follows: <br /> <br /> Council Chambers, City Hall <br /> 603 Main Street, Pleasanton, California; at <br /> <br /> 8:00 p.m., Monday, October 30, 1961. <br /> <br /> Said hearing may be postponed or continued. <br /> <br /> 4. Notices of street vacation shall be posted consp_lcuously <br />along the line of the street or part thereof proposed or intende, <br />to be vacated at least ten (10) days before the date set for <br />hearing. Such notices shall be posted not more than three <br />hundred feet apart, but at least three such notices shall be post~ d. <br />Such notices shall state the passage of the Resolution of Intention <br />and the time and place of the hearing. <br /> <br />- 1 - <br /> <br /> <br />
