CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. 1092 <br /> <br />AN ORDINANCE AMENDING THE CITY BINGO ORDINANCE <br />TO CLARIFY INTERPRETATION AND BRING SAID ORDINANCE <br />INTO CONFORMITY WITH CHANGES IN PENAL CODE SECTION <br />326.5 <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1: Section 4-2.1810(c) of the Pleasanton Municipal <br /> Code is hereby amended to read as follows: <br /> <br />"(c) An eligible organization shall conduct bingo <br /> games only on property owned or leased by it <br /> or property whose use is donated to the organi- <br /> zation and which property is used by such <br /> orgnization for an office or for performance <br /> of purposes for which the organization is organized. <br /> In the case of property not continuously used <br /> by the authorized organization, the property shall <br /> be considered as used for the purposes for which <br /> the organization is organized if the authorized <br /> organization is conducting a scheduled event for <br /> organizational purposes on the premises and the <br /> Police Chief makes a determination that the <br /> proposed bingo game is merely incidental to the <br /> scheduled event." <br /> <br />Section 2: <br /> <br /> Section 4-2.1810(e) of the Pleasanton Municipal <br />Code is amended by adding the following sentence <br />at the end: <br /> <br />"This subdivision does not preclude the employment <br />of security personnel who are not members of the <br />authorized organization at such bingo game by the <br />organization conducting the game." <br /> <br />Section 3: Section 4-2.1811(b)(2) of the Pleasanton Municipal <br /> Code is hereby amended to read as follows: <br /> <br />"(2) A portion of such proceeds not to exceed 20% <br /> of the proceeds after the deduction for <br /> prizes, or One Thousand Dollars ($1,000) Der <br /> month, whichever is less, may be used for <br /> rental of property, overhead, administrative <br /> expenses, security equipment and security <br /> personnel." <br /> <br /> <br />
