RESOLUTION NO. 11-475 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DENYING CASE P11-0035, THEREBY UPHOLDING THE PLANNING COMMISSION'S APPROVAL OF THE APPLICATION OF SUMMER BOWERS FOR A CONDITIONAL USE PERMIT APPLICATION, AS FILED UNDER CASE PCUP-296 WHEREAS, Summer Bowers applied for a Conditional Use Permit application for the operation of a State-exempt child care learning center located at 1020 Serpentine Lane, Suite 109, during the summer only; and WHEREAS, zoning fcr the property is Planned Unit Development — Industrial (PUD-I) District; and WHEREAS, at its meeting of June 8, 2011, the Planning Commission, having considered all public testimony, relevant exhibits, and recommendations of City staff concerning this application, approved the application; and WHEREAS, within the time specified by the Pleasanton Municipal Code, Valley Business Park's Board of Director's submitted an appeal of the decision of the Planning Commission to the City Council; and WHEREAS, at its meeting of August 16, 2011 the City Council received a report from the Director of Community Development, together with a copy of the staff report to the Planning Commission, regarding this matter; and WHEREAS, the City Council held a public hearing on August 16, 2011, at which time the appellants and any other member of the public were offered an opportunity to present evidence regarding the appeal; and WHEREAS, after a review of the materials presented, the City Council determined that, as conditioned, the proposed State-exempt child care learning center would be a compatible use within Valley Business Park and would be consistent with the zoning regulations of the zoning district of the property. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. Denies the appeal, P11-0035, thereby upholding the decision of the Planning Commission approving PCUP-296, the application of Summer Bowers for a Conditional Use Permit application to operate a State-Exempt child care learning center at 1020 Serpentine Lane, Suite 109, during the summer only, subject to the conditions shown on Exhibit A, attached hereto and made a part of this case by reference. SECTION 2. This resolution shall become effective immediately upon its passage and adoption. PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on August 16, 2011. 1
