RESOLUTION NO. 11-475 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DENYING <br /> CASE P11-0035, THEREBY UPHOLDING THE PLANNING COMMISSION'S <br /> APPROVAL OF THE APPLICATION OF SUMMER BOWERS FOR A CONDITIONAL <br /> USE PERMIT APPLICATION, AS FILED UNDER CASE PCUP-296 <br /> WHEREAS, Summer Bowers applied for a Conditional Use Permit application for the <br /> operation of a State-exempt child care learning center located at 1020 Serpentine Lane, Suite <br /> 109, during the summer only; and <br /> WHEREAS, zoning fcr the property is Planned Unit Development — Industrial (PUD-I) <br /> District; and <br /> WHEREAS, at its meeting of June 8, 2011, the Planning Commission, having <br /> considered all public testimony, relevant exhibits, and recommendations of City staff concerning <br /> this application, approved the application; and <br /> WHEREAS, within the time specified by the Pleasanton Municipal Code, Valley <br /> Business Park's Board of Director's submitted an appeal of the decision of the Planning <br /> Commission to the City Council; and <br /> WHEREAS, at its meeting of August 16, 2011 the City Council received a report from <br /> the Director of Community Development, together with a copy of the staff report to the Planning <br /> Commission, regarding this matter; and <br /> WHEREAS, the City Council held a public hearing on August 16, 2011, at which time the <br /> appellants and any other member of the public were offered an opportunity to present evidence <br /> regarding the appeal; and <br /> WHEREAS, after a review of the materials presented, the City Council determined that, <br /> as conditioned, the proposed State-exempt child care learning center would be a compatible <br /> use within Valley Business Park and would be consistent with the zoning regulations of the <br /> zoning district of the property. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. Denies the appeal, P11-0035, thereby upholding the decision of the <br /> Planning Commission approving PCUP-296, the application of Summer Bowers for a Conditional <br /> Use Permit application to operate a State-Exempt child care learning center at 1020 Serpentine <br /> Lane, Suite 109, during the summer only, subject to the conditions shown on Exhibit A, attached <br /> hereto and made a part of this case by reference. <br /> SECTION 2. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on August 16, 2011. <br /> 1 <br />
