EXHIBIT IBIT E <br /> THE CITY OF A <br /> -=� CITY COUNCIL AGENDA REPORT }V( <br /> pL£ASANTONo <br /> December 7, 2010 <br /> Community Development <br /> Planning Division <br /> TITLE: PUD-82, DAVID DiDONATO, DONATO BUILDERS, INC. — CONSIDER <br /> AN APPLICATION FOR REZONING OF AN APPROXIMATELY 1.17- <br /> ACRE SITE AT 4171 AND 4189 STANLEY BOULEVARD FROM <br /> R-1-6,500 (ONE-FAMILY RESIDENTIAL) DISTRICT TO PLANNED UNIT <br /> DEVELOPMENT — HIGH DENSITY RESIDENTIAL (PUD-HDR) <br /> DISTRICT AND FOR DEVELOPMENT PLAN APPROVAL TO <br /> CONSTRUCT 14 DETACHED SINGLE-FAMILY HOMES <br /> SUMMARY <br /> The applicant proposes to demolish an existing single-family home and construct 14 <br /> detached single-family homes on a site in the Downtown Specific Plan (DTSP) Area. <br /> The proposed rezoning to PUD-HDR and the proposed density of 12.0 units per acre <br /> are consistent with the General Plan and Downtown Specific Plan land use designations <br /> of High Density Residential (greater than eight dwelling units per gross acre) for the site. <br /> Adjacent neighbors have expressed concern regarding density, housing affordability, <br /> parking, traffic, house setbacks, loss of views and sunlight, building heights, drainage, <br /> and tree loss. The Planning Commission (4-1 vote) determined that the project was <br /> appropriate in density and design and that the development would be compatible with <br /> the surrounding area. The applicant is in agreement with the Planning Commission's <br /> recommended conditions of approval. <br /> PLANNING COMMISSION ACTION <br /> Recommend approval of the PUD rezoning and development plan application subject to <br /> the conditions shown in Exhibit "A" (Attachment #1). <br /> RECOMMENDATION <br /> 1. Find that there are no new or changed circumstances or information which require <br /> additional CEQA review of the project; <br /> 2. Find that the proposed PUD rezoning and development plan are consistent with the <br /> General Plan and Downlown Specific Plan; <br /> 3. Make the PUD findings for the proposed development plan as stated in the <br /> September 15, 2010, Planning Commission staff report (Attachment #7); and <br /> 4. Introduce the draft crd nance approving Case PUD-82, PUD rezoning from R-1- <br /> 6,500 (One-Family Residential) District to PUD-HDR (Planned Unit Development — <br /> High Density Residential) District and development plan approval to construct 14 <br />
