Environmental Quality Act (CEQA). The California Environmental Quality Act (CEQA) <br /> specifies that residential development projects that are proposed pursuant to the <br /> requirements of an adopted specific plan for which an EIR has been prepared and <br /> certified are exempt from additional environmental review provided: <br /> 1. There are no substantial changes to the project or to the circumstances under <br /> which the project is being undertaken that involve new significant environmental <br /> effects or that substantially increase the severity of previously identified effects; <br /> or, <br /> 2. That new information of substantial importance which was not known at the time <br /> the previous EIR was certified shows the project will have one or more significant <br /> effects not discussed in the EIR. <br /> The reduction of the proposed density from 14 to 13 units will reduce the traffic <br /> generation and draws upon City utilities and services by the development of this site. <br /> Window assemblies with upgraded STC ratings will reduce the impacts from railroad <br /> operations to interior living areas of the revised proposal. There are no new <br /> circumstances or information that will result in a new and significant environmental <br /> effect that was not already addressed by the Final EIR completed for the Downtown <br /> Specific Plan. Staff, therefore, recommends that the revised project be reviewed <br /> without any additional CEQA review or process. <br /> IX. STAFF RECOMMENDATION <br /> Staff recommends the Planning Commission forward Case PUD-82 to the City Council <br /> with a recommendation of approval by taking the following actions: <br /> 1. Find that there are no new or changed circumstances or information which <br /> requires additional CEQA review of the project; <br /> 2. Find that the proposed PUD rezoning and development plan are consistent with <br /> the General Plan and Downtown Specific Plan; <br /> 3. Make the PUD findings for the proposed development plan as listed in the <br /> attached Planning Commission staff report; and, <br /> 4. Adopt the draft resolution recommending approval of Case PUD-82, PUD <br /> rezoning from R-1-6,500 (One-Family Residential) District to PUD-HDR (Planned <br /> Unit Development — High Density Residential) and development plan approval to <br /> construct 13 detached single-family homes, subject to the conditions of approval <br /> listed in Exhibit B. <br /> Staff Planner Marion Pavan, Associate Planner, 925-931-5610 or mpavan a,ci.pleasanton.ca.us. <br /> Item 6.a., PUD-82 Page 22 of 22 July 13, 2011 <br />
