THE CITY OF 11 <br /> "' CITY COUNCIL AGENDA REPORT <br /> pL E ASANTON„ <br /> September 9, 2011 <br /> Community Development <br /> Planning Division <br /> TITLE: PUD-82, DAVID DiDONATO, DONATO BUILDERS, INC. — <br /> APPLICATION FOR REZONING OF AN APPROXIMATELY 1.17-ACRE <br /> SITE AT 4171 AND 4189 STANLEY BOULEVARD FROM R-1-6,500 <br /> (ONE-FAMILY RESIDENTIAL) DISTRICT TO PLANNED UNIT <br /> DEVELOPMENT — HIGH DENSITY RESIDENTIAL (PUD-HDR) <br /> DISTRICT AND FOR DEVELOPMENT PLAN APPROVAL TO <br /> CONSTRUCT 13 DETACHED SINGLE-FAMILY HOMES <br /> SUMMARY <br /> The applicant proposes to demolish an existing single-family home and construct 13 <br /> detached single-family homes, a density reduction from the previously proposed 14-unit <br /> development plan, on a site in the Downtown Specific Plan (DTSP) Area. The proposed <br /> rezoning to PUD-HDR and the proposed density of 11.1 units per acre are consistent <br /> with the General Plan and Downtown Specific Plan land use designations of High <br /> Density Residential (greater than eight dwelling units per gross acre) for the 1.17-acre <br /> site. Public comment on the development of this property includes density, housing <br /> affordability, parking, traffic, house setbacks, loss of sunlight, building heights, drainage, <br /> and tree loss. The Planning Commission (5-0 vote) determined that the project now <br /> with 13 units is appropriate in density and design and that the development would be <br /> compatible with the surrounding area. The applicant concurs with the Planning <br /> Commission's recommended conditions of approval. <br /> PLANNING COMMISSION ACTION <br /> Recommended approval (5-0) of the PUD rezoning and development plan application <br /> subject to the conditions shown in Exhibit "A" (Attachment#1). <br /> RECOMMENDATION <br /> 1. Find that there are no new or changed circumstances or information which require <br /> additional CEQA review of the project; <br /> 2. Find that the proposed PUD rezoning and development plan are consistent with <br /> the General Plan and Downtown Specific Plan; <br /> 3. Make the PUD findings for the proposed development plan as stated in the July 13, <br /> 2011, Planning Commission staff report (Attachment#4); and <br /> 4. Introduce the draft ordinance approving Case PUD-82, PUD rezoning from R-1- <br /> 6,500 (One-Family Residential) District to PUD-HDR (Planned Unit Development — <br /> High Density Residential) District and development plan approval to construct 13 <br />
