PLEASANTON POLICE DEPARTMENT <br /> TOW SERVICE AGREEMENT <br /> 09/01/2011—06/30/2013 <br /> This Tow Service Agreement (TSA" or"Agreement") is between the CITY OF <br /> PLEASANTON, a municipal corporation ("City"), and <br /> whose address is , and telephone number is <br /> , ("Tow Company" or"Operator"). <br /> This Agreement contains terms and conditions with which the Operator agrees to <br /> comply to receive a rotation tow listing in the Rotation Tow Program of the Pleasanton Police <br /> Department (PPD). Compliance with all of the terms and conditions of the TSA is mandatory as <br /> a condition for the Operator to participate in the Rotation Tow Program. <br /> 1. DEFINITIONS <br /> A. Enrollment Period:_The time period when an Operator may submit an application to be <br /> considered for enrollment in the PPD's Rotation Tow Program. For the term September <br /> 1, 2011-June 30, 2013, the enrollment periods are from August 1—30, 2011 and June 1 <br /> —30, 2012. For subsequent terms, the enrollment period is from June 1—30 of each <br /> year. <br /> B. Operator: A tow service owner or managing director of a tow business who has agreed <br /> to abide by the TSA to be part of the Rotation Tow Program. "Operator" shall include <br /> the tow service and the tow service's owners, employers, employees and agents. <br /> C. Police Chief: Police Chief or the Police Chief's designee. <br /> D. Rotation Tow Program:The tow service program in which Operators that have been <br /> approved by the PPD to provide tow service as requested by the PPD in accordance with <br /> the TSA. <br /> E. Special Operations Commander: The Special Operations Commander or Police Chiefs <br /> designee. <br /> 2. OPERATOR'S STATUS <br /> An Operator shall not be considered an agent or employee of the City of Pleasanton when <br /> performing services under the TSA. All persons working for or under the direction of <br /> Operator are its agents and employees and are not agents or employees of the City of <br /> Pleasanton. <br /> 2011-2013 TSA Page 4 of 30 <br />
