23.TERMS OF DISCIPLANARY ACTION <br /> A. Violations of the terms and conditions of the TSA, as determined by the Special <br /> Operations Commander, may be cause for disciplinary action, a minimum of which is the <br /> following: <br /> 1) First violation within a 12 month period: letter of written reprimand. <br /> 2) Second violation within a 12 month period: 1 to 30 calendar day suspension. <br /> 3) Third violation within a 12 month period: 60 to 90 calendar day suspension. <br /> 4) Fourth violation within a 12 month period: termination of the TSA with that <br /> Operator. <br /> In lieu of termination, the Special Operations Commander may impose additional <br /> suspensions for longer periods, if deemed appropriate. <br /> B. Violations of the TSA that are subject to suspension for the first violation as set forth in <br /> the TSA are categorized as major violations. Any subsequent or continuing major <br /> violation may be cause for termination of the TSA. <br /> 1) When considering punitive action for a major violation of the TSA, the Special <br /> Operations Commander should take into consideration all violations that occurred <br /> within 36 months prior to the date of the current violation. <br /> C. A suspended or terminated Operator, and/or the tow business owner at the time of the <br /> suspension or termination, shall not be eligible for a rotation listing for the duration of <br /> the suspension or termination. <br /> 1) This provision applies to the Operator working in any capacity within the tow <br /> business or operating any tow business, even if operated under new ownership. <br /> D. If an Operator is serving a suspension for six months or more, the Operator shall be <br /> required to comply with all terms and conditions of the current TSA at the time of <br /> reinstatement. If the TSA term expires, the Operator must resubmit an application <br /> during the enrollment period. <br /> E. An Operator shall comply with all the terms of the suspension, including, but not limited <br /> to, restitution to victims and court orders, prior to reinstatement or re-application. <br /> 2011-2013 TSA Page 27 of 30 <br />
