G. The PPD shall have discretion to honor a Level One Inspection from a CHP Facility <br /> conducted within 30 calendar days of the inspection date and upon presentation of the <br /> completed CHP 407F form. <br /> 14. RATES <br /> A. Fees charged for calls originating from the PPD shall be reasonable, valid, and not in <br /> excess of those rates charged for similar services provided in response to requests <br /> initiated by a public agency or private person. <br /> 1) The reasonableness of the fees charged shall be determined by comparing the fees <br /> with other similar service rates. <br /> 2) The validity of the fees shall be based upon the following: telephone quotes, <br /> invoices, posted rates, charges to retail customers, and other relevant <br /> considerations. <br /> 3) Regardless of the class of tow truck utilized or responding to the call, charges shall <br /> not be more than required for the class of vehicle towed or serviced, except when <br /> vehicle recovery operations require a larger class of tow truck. <br /> B. Based upon the average of the proposed fees submitted, the Special Operations <br /> Commander shall determine the reasonableness and validity of all submitted rates(e.g., <br /> storage, non-skilled labor, and special equipment). <br /> C. An Operator who submits a rate, which is determined by the Special Operations <br /> Commander to be unreasonable and/or invalid, shall be allowed to re-submit rates only <br /> once. <br /> 1) If the re-submitted rate is unreasonable and/or invalid, the Operator shall be <br /> disqualified until the next enrollment period. <br /> 2) An Operator shall be provided with written notification regarding the <br /> disqualification within 30 calendar days of submitting, or re-submitting (if <br /> applicable), the rate. <br /> D. Rate requirements represent the maximum an Operator may charge on a PPD call. <br /> 1) An Operator is not precluded from charging less when deemed appropriate by the <br /> Operator. <br /> 2) These requirements shall only be construed as requiring a charge if an Operator <br /> would not normally charge for such a service. <br /> E. An Operator may lower its retail rates at any time by notifying in writing the PPD. <br /> 2011-2013 TSA Page 18 of 30 <br />
