CITY COUNCIL AGENDA REPORT <br /> pLEASANTONo <br /> August 16, 2011 <br /> Community Development <br /> Planning Division <br /> TITLE: REQUEST FOR PREANNEXATION AGREEMENT AND WATER AND <br /> SEWER CONNECTIONS FOR THE THREE LOT SUBDIVISION <br /> APPROVED BY THE ALAMEDA COUNTY PLANNING DEPARTMENT <br /> (364 LINDEN WAY — SIA HASHEMI) <br /> SUMMARY <br /> The property located at 364 Linden Way is located within the unincorporated area of <br /> Alameda County known as the Remen Tract. The property owner recently received an <br /> approval from the County to subdivide the 38,400 square foot parcel into three lots with <br /> the condition that the property must connect to the City's water and sewer systems. <br /> When a property is within 200 feet of a public sewer line, Alameda County Department <br /> of Environmental Health regulations require all new development utilize the public sewer <br /> system. Prior to allowing a property owner to connect to the City water and sewer <br /> systems, the City requires the property owner to enter into a preannexation agreement. <br /> Although the three-lot subdivision meets the County's development standards of R-1-B- <br /> 10 (Single-Family Residence, 10,000 square foot minimum building site area), one of <br /> the proposed interior lots does not meet the City's R-1-10,000 Zoning District' <br /> regulations. Staff informed the property owner that one of his lots did not meet the <br /> required width of 80 feet, but the property owner chose to seek County approval instead <br /> of modifying the project so that it would conform to both the County and the City's <br /> zoning regulations. <br /> RECOMMENDATION <br /> Not to authorize the connections to the City's water and sewer service due to the <br /> creation of a substandard lot; not to approve a preannexation agreement. <br /> FINANCIAL STATEMENT <br /> If the Council authorizes the connection to the City's utility system and a preannexation <br /> agreement upon the approval by Alameda County Local Agency Formation Commission <br /> (LAFCo), the property owner would be required to pay all costs associated with <br /> installation of sewer and water laterals for the proposed house, including costs <br /> associated with extending the sewer main on Linden Way and water mains and fire <br /> hydrants on Linden Way and Vine Street. The owner will also pay for water and sewer <br /> connection fees, permits, and fees required by the City, County, and LAFCo. <br /> The City's R-1-10,000 zoning district development standards require the minimum lot width for an <br /> interior lot be 80 feet. One of the interior lots approved by the county has a lot width of 75 feet, five feet <br /> narrower than what is required by Pleasanton. <br />
