30. That the developer pay any and all fees that the <br /> property may be subject to. <br /> <br /> 31. That the apartments shall stay as rental units for a <br /> minimum of seven (7) years from the date of approval of <br /> case PUD-8 3-1. <br /> <br />32. That the colors of all structures shall be approved by <br /> the Planning Division prior to the issuance of a building <br /> permit. <br /> <br />33. That by the end of the first year from the time of initial' <br /> occupancy, thirty-five (35) of the 144 apartment units shall <br /> be rented to senior citizens (aged 50 or older). At least <br /> 35 units shall be rented to senior citizens beginning from <br /> that time until the units cease to be rental apartments. <br /> <br />34. That the location of any pad mounted transformers shall= <br /> be subject to approval by the Planning Division prior go <br /> issuance of a building permit. Generally speaking such <br /> transformers shall not-be located between any street and <br /> the front of a building. <br /> <br />35. That approval of the design for the line, grade, and <br /> structural sections for the streets serving this develop- <br /> ment be withheld pending final design and review by the <br /> City Engineer. <br /> <br />36. That the developer secure approval from the Planning Director <br /> for all proposed street names prior to submittal of the final <br /> map. <br /> <br />37. That vertical P.C.C. curbs and gutters be constructed <br /> within this development unless otherwise approved by <br /> the City Engineer and that the curb and gutter be <br /> poured monolithically with the sidewalk when the <br /> sidewalk is adjacent. <br /> <br />38. That ~ detailed grading and drainage plan and all <br /> supporting information and design criteria be submitted <br /> as part of the improvement plans for the development. <br /> <br /> <br />
