Proposal for Consultant Services <br /> Pleasanton Aquatic Center Renovation <br /> Page 5 of 9 <br /> 4.1.3 Preparation of measured drawings of existing structures. <br /> 4.1.4 Preparation of or site lighting plans. <br /> 4.1.5 Seismic analysis and structural improvements for existing buildings to <br /> remain. <br /> 4.1.6 Design of photo voltaic or thermal solar systems. <br /> 4.1.7 Design of shade structures. <br /> 4.1.8 Presentation renderings or models. <br /> 4.1.9 Soils testing/engineering, including finalized geotechnical investigation <br /> report. Note: Unusual soil conditions such as expansive soils, fill soils, <br /> soils with low bearing capacity (under 2,000 psf), and high water tables <br /> which require additional engineering will be considered an additional <br /> service and compensated for in conformance with Article 5.1.2, below. <br /> 4.1.10 Destructive testing of existing pool structures to confirm as-built <br /> condition. Note: CONSULTANT cannot guarantee structural integrity <br /> of existing pool structures without confirming as-built condition of pool <br /> wall thickness, concrete reinforcement and compressive strength. <br /> Additional engineering for deficient structures will be considered an <br /> additional service and compensated for in conformance with Article <br /> 5.1.2, below. <br /> 4.1.1 1 Miscellaneous plan check and permit fees as may be required by <br /> regulatory agencies. <br /> 5.0 INDEMNITY <br /> 5.1 The CONSULTANT agrees, to the fullest extent permitted by law, to <br /> indemnify and hold the CLIENT harmless from any damage, liability or cost <br /> (including reasonable attorney's fees and costs of defense) to the extent caused <br /> by the CONSULTANT's negligent acts, errors or omissions in the performance <br /> of professional services under this Agreement and those of his or her <br /> subconsultants or anyone for whom the CONSULTANT is legally liable.
