CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1075 <br /> <br /> AN ORDINANCE AMENDING CHAPTER 15 (CONDOMINIUM <br /> CONVERSION PROJECTS) OF TITLE II (ZONING AND <br /> DEVELOPMENT) OF THE ORDINANCE CODE OF THE CITY OF <br /> PLEASANTON AND CERTAIN PROCEDURES THEREUNDER <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br /> ORDAIN AS FOLLOWS: <br /> <br /> Section 1: Section 2-25.06 (Procedures) of Chapter 15 <br /> (Condominium Conversion Projects) of Title II <br /> (Zoning and Development) of the Ordinance Code of <br /> the City of Pleasanton is hereby amended by adding <br /> a new subsection "c" to read as follows: <br /> <br /> "c. Condominium conversion approval shall lapse <br /> if a final map has not been filed with the <br /> City Council for approval within one (1) year <br /> of receipt of condominium conversion approval, <br /> or such other time~ as'may be set at the time <br />_ of conversion app.roval." <br /> <br /> Section 2: Subsection 2-25.10(b) (Rent Increase Protection) <br /> of Chapter 15 (Condominium Conversion Projects) of <br /> Title II (Zoning and Development) of the Ordinance <br /> Code of the City of Pleasanton is hereby amended <br /> in its entirety to read as follows: <br /> <br /> "b. Rent Increase Protection <br /> <br /> (1) No application for conversion shall be <br /> approved if rents have been raised on <br /> any unit, whether affecting existing <br /> tenants or at change of occupancy, <br /> during the period six months prior to <br /> the date of approval of the condominium <br /> conversion project. The provisions of <br /> this subsection shall not apply to <br /> conversions processed pursuant to Section <br /> 2-25.05(b). <br /> <br /> (2) The leases of tenants continuing to <br /> reside in the project during the period <br /> between approval of the condominium con- <br /> version project and sale of the unit <br /> shall be under the same terms and conditions <br /> as existed at the time of the approval, <br /> except that rent may increase at an <br /> <br /> -1- <br /> <br /> <br />
