CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO~ 1063 <br /> <br /> APPROVING THE APPLICATION OF RICHARD HEMPY FOR <br /> DEVELOPMENT PLAN APPROVAL FOR A FOUR-LOT RESIDENTIAL <br /> SUBDIVISION ON APPROXIMATELY 4.35 ACRES OF LAND ON <br /> THE WEST SIDE OF FOOTHILL ROAD ADJACENT ON THE <br /> SOUTH TO 5050 FOOTHILL ROAD (PUD-82-17) <br /> <br />WHEREAS, Richard Hempy applied for development Plan approval <br /> for a four-lot residential subdivision on approximately <br /> 4.35 acres of land on the west side of Foothill Road <br /> adjacent on the south to 5050 Foothill Road; and <br /> <br />WHEREAS, at its meeting of October 13, 1982, the Planning <br /> Commission denied the application; and <br /> <br />WHEREAS, within the time specified by the Ordinance Code of <br /> the City of Pleasanton, the applicant submitted an <br /> appeal to the decision of the PlanninK Commission to <br /> the City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, at its meeting of November 23, 1982, the City Council <br /> reviewed a report dated November 1, 1982 from the <br /> Director of Planning and Community Development together <br /> with copies of staff reports to the Planning Commission <br /> regarding this matter; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a mitigated <br /> negative declaration was adopted by Council on <br /> November 23, 1982; and <br /> <br />WHEREAS, the City Council held a public hearing at which time the <br /> applicant and any other member of the public was offered <br /> an opportunity to present evidence regarding this <br /> appeal; and <br /> <br />WHEREAS, the City Council {inds that this development plan is <br /> consistent with the General Plan policies of the <br /> City of Pleasanton; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br /> Section 1: Approves the development plan for construction of <br /> a four-lot residential subdivision on aDproximately <br /> 4.35 acres of land on the west side of Foothill Road <br /> adjacent on the south to 5050 Foothill Road (PUD-82-17), <br /> subject to the conditions on Exhibit "A" attached <br /> hereto and by this reference incorporated herein. <br /> <br /> <br />
