AGREEMENT <br /> <br />and MacKAY & SOMPS, <br />"Engineers"; <br /> <br /> THIS AGREEMENT, made and entered into this 14th day <br /> <br />of November, 1963, by and between the CITY OF PLEASANTON, a municipal <br />~orporation of the State of California, hereinafter called "City", <br /> <br /> registered civil engineers, hereinafter called <br /> <br /> WI TNES SETH : <br /> <br /> That for and in consideration of the mutual covenants and <br />agreements herein contained, the parties hereto agree as follows: <br /> <br /> 1. City proposes to initiate special assessment proceed- <br />ings for the construction of improvements in "Assessment District No. <br />63-1, City of Pleasanton, County of Alameda, State of California". <br /> <br /> 2. City hereby employs Engineers as Engineer of Work for <br />the doing of all necessary work and exercising all functions provided <br />for the office of City Engineer under the provisions of the Municipal <br />Improvement Act of 1913 in connection with the construction of improve- <br />ments to be made in said Assessment District No. 63-1. Said services <br />shall include the following: <br /> <br /> a. Doing of all necessary engineering work and engineering <br /> of all functions provided for the office of City <br /> Engineer in the Municipal Improvement Act of 1913; <br /> <br /> b. Preparation and furnishing of all surveys, original <br /> drawings, maps and blueprints, plans and specifications, <br /> preparation of assessment roll, assessment diagram, and <br /> any and all other services which may be required from <br /> the Engineer of Work under the provisions of the said <br /> Municipal Improvement Act of 1913; <br /> <br /> c. Supervision and direction of all engineering work required <br /> to be taken by City, or its officers, agents or employees <br /> in connection with said construction of improvements; <br /> <br /> d. Rendition of general consultation and advice to City, <br /> its officers and employees or agents with respect to the <br /> planning, preparation and handling of all engineering <br /> phases of the aforesaid proceedings; <br /> <br /> e. Attendance at such conferences and public meetings in <br /> City as may be reasonably necessary to perform this <br /> contract of employment. <br /> <br /> 3. Engineers' compensation shall b~ the sum of ~, 4&,04g,~ <br />Said fee shall be paid by City out of the proceeds of assessments <br />levied and bonds to be issued in said proceedings, or on February 1, <br />1964, whichever date is later. <br /> <br />-1- <br /> <br /> <br />
