terms and conditions of the petition he~einabove refer=ed to, and <br /> the contract between the said STURGIS, DEN-DULK, DOUGLASS & ANDERSON <br /> and the City of Pleasanton to be hereafter entered into. <br /> <br /> 5. That the public interest and convenience will be served <br /> by the taking of special assessment proceedings for the construction <br /> of the improvements set forth in said petition. Said work is of more <br /> than ordinary public benefit and the cost and expenses thereof should <br /> be borne by a district benefited by said construction of improvements'. <br /> Said district shall be known and designated as "Assessment District No. <br /> 63-1, City of Pleasanton, County of Alameda, State of California". <br /> <br /> 6. The district which shall bear the cost and expenses of <br /> said construction of improvements, including all incidental expenses, <br /> and which is to be assessed to pay for the cost of said construction <br /> of improvements, is that district shown on a map which iS on file <br /> in the office of the City Clerk of the City of ?leasanton, which is <br /> designated, "Map Showing Boundaries of District Proposed to be <br /> Assessed for Construction of Improvements in Assessmemt District No. <br /> 63-1, Mission Park Assessment District No. 1, City of Pleasangon, <br /> County of Alameda, State of California". <br /> <br /> 7. That in view of the fact that 100% of the owners of <br /> <br />the property within the area to be assessed for the cost of said con- <br />struction of improvements have petitioned for said improvements, this <br />City Council hereby finds that the public intermit and convenience <br />require that this City Council undertake proceedings!for the construc- <br />tion of improvements under the provisions of the Municipal Improvement <br />Act'of 1913 and the Improvement Bond Act of 1915, and without further <br />compliance with the provisions of the Special Assessment Investigation, <br />Limitation and Majority Protest Act of 1931 of the State of California, <br />now found in Division 4 of the Streets and Highways Code. <br /> <br /> 8. That the moneys received from the proceeds of assessments <br />levied and bonds issued will be disbursed in accordance with the prayer <br />of the petition and in accordance with schedule of costs on file with <br />the City Clerk of the City of Pleasanton. Said moneys in payment of <br />the construction of improvements shall be payable upon certification <br />of the City Zngineer of the City of Pleasanton and the Engineer of <br />Work that said work has been completed in accordance with the standards <br /> <br />-2- <br /> <br /> <br />
