AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into this 24th day of Feb- <br /> ruary, 1964, by and between the CITY OF PI~EASANTON, a municipal corpora- <br /> tion of ~he State of California, hereinafter called "City", and MacKAY & <br /> SOMPS, registered civil engineers, hereinafter called "Engineers"; <br /> <br /> WITNESSETH : <br /> <br /> That for and in consideration of the mutual covenants and <br /> agreements herein contained, the parties hereto agree as follows: <br /> <br /> 1. City proposes to initiate special assessment proceedings <br /> for the acquisition of improvements in "Assessment District No. 64-1, <br /> City of Pleasanton, County of Alameda, State of California". <br /> <br /> 2. City hereby employs Engineera as Engineer of Work for the <br /> doing of all necessary work and exercising all functions provided for <br /> the office of City Engineer under the provisions of the Municipal Im- <br /> provement Act of 1913 in connection with the acquisition of improvements <br /> ~o be made in said Assessment District No. 64-1. Said services shall in- <br /> clude the following: <br /> <br /> a. Doing of all necessary engineering work and engineering <br /> of all functions provided for the office of City Engineer <br /> in the Municipal Improvement Act of 1913; <br /> <br /> b. Preparation and furnishing of all surveys, original draw- <br /> ings, maps and blueprints, plans and specifications, pre- <br /> paration of assessment roll, assessment diagram, and any <br /> and all other services which may be required from the <br /> Engineer of Work under the provisions of the said Municipal <br /> Improvement Act of 1913; <br /> <br /> c. Supervision and direction of all engineering work required <br /> to be taken by City, or its officers, agents or employees <br /> in connection with the acquisition of improvements; <br /> <br /> d. Rendition of general consultation and advice to City, its <br /> officers and employees or agents with respect to the <br /> planning, preparation and handling of all engineering <br /> phases of the aforesaid proceedings~ <br /> <br /> e. Attendance at such conferences and public meetings in City <br /> as may be reasonably necessary to perform this contract of <br /> employment. <br /> <br /> 3. Engineers, compensation shall be the..~sum of <br /> <br />Said fee shall be paid by City out of the proceeds of assessments levied <br />and bonds to be issued in said proceedings. <br /> <br />4. In the event She proceedings are not carried through <br />conclusion, or shall be abandoned, then Engineers shall receive nothing. <br /> <br />-1- <br /> <br /> <br />
