ATTACHMENT 1 <br /> RESOLUTION NO. 11- <br /> RESOLUTION DENYING CASE P11-0035, THEREBY UPHOLDING THE PLANNING <br /> COMMISSION'S APPROVAL OF THE APPLICATION OF SUMMER BOWERS FOR A <br /> CONDITIONAL USE PERMIT APPLICATION, AS FILED UNDER CASE PCUP-296 <br /> WHEREAS, Summer Bowers applied for a Conditional Use Permit application for <br /> the operation of a State-exempt child care learning center located at 1020 Serpentine <br /> Lane, Suite 109, during the summer only; and <br /> WHEREAS, zoning for the property is Planned Unit Development — Industrial <br /> (PUD-I) District; and <br /> WHEREAS, at its meeting of June 8, 2011, the Planning Commission, having <br /> considered all public testimony, relevant exhibits, and recommendations of City staff <br /> concerning this application, approved the application; and <br /> WHEREAS, within the time specified by the Pleasanton Municipal Code, Valley <br /> Business Park's Board of Director's submitted an appeal of the decision of the Planning <br /> Commission to the City Council; and <br /> WHEREAS, at its meeting of July 19, 2011 the City Council received a report <br /> from the Director of Community Development, together with a copy of the staff report to <br /> the Planning Commission, regarding this matter; and <br /> WHEREAS, the City Council held a public hearing on July 19, 2011, at which <br /> time the appellants and any other member of the public were offered an opportunity to <br /> present evidence regarding the appeal; and <br /> WHEREAS, after a review of the materials presented, the City Council <br /> determined that, as conditioned, the proposed State-exempt child care learning center <br /> would be a compatible use within Valley Business Park and would be consistent with <br /> the zoning regulations of the zoning district of the property. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br /> FOLLOWING: <br /> Section 1. Denies the appeal, P11-0035, thereby upholding the decision of the <br /> Planning Commission approving PCUP-296, the application of Summer Bowers for a <br /> Conditional Use Permit application to operate a State-Exempt child care learning center at <br /> 1020 Serpentine Lane, Suite 109, during the summer only, subject to the conditions shown <br /> on Exhibit A, attached hereto and made a part of this case by reference. <br /> SECTION 2. This resolution shall become effective immediately upon its <br /> passage and adoption. <br /> 1 <br />
