ATTACHMENT 1 DRAFT ORDINANCE NO. XXX AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE APPLICATION OF LYNN JANSEN FOR REZONING, AS FILED UNDER CASE PRZ-59 WHEREAS, Lynn Jansen has applied to rezone an approximately 3.0 acre portion of an existing approximately 4.0 acre parcel (APN 946-3477-001-00) from the A (Agricultural) zoning district to PUD-MDR (Planned Unit Development— Medium Density Residential) zoning district; and WHEREAS, based on the Initial Environmental Study, a Negative Declaration was adopted by City Council on July 19, 2011; and WHEREAS, at its meeting of July 19, 2011, the City Council received the Planning Commission's unanimous recommendation for approval of the rezoning; and WHEREAS, a duly noticed public hearing was held on July 19, 2011; and, WHEREAS, after review of the materials presented, the City Council determined that the rezoning is consistent with the General Plan adopted on July 21, 2009. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES THEREBY ORDAIN AS FOLLOWS: Section 1. Approves the rezoning of an approximately three (3) acre portion of an existing approximately four (4) acre parcel (APN 946-3477-001-00) located at 1623 Cindy Way to PUD-MDR (Planned Unit Development— Medium Density Residential). Section 2. The Zoning Map of the City of Pleasanton dated April 18, 1960, on file with the City Clerk, designating and dividing the city into zoning districts is hereby amended by Zoning Unit Map No. 477, attached hereto as Exhibit A, dated July 19, 2011, and incorporated herein by this reference. Section 3. A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption. Section 4. This ordinance shall be effective thirty (30) days after its passage and adoption.
