ATTACHMENT 1 <br /> DRAFT ORDINANCE NO. XXX <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF LYNN JANSEN FOR REZONING, AS FILED <br /> UNDER CASE PRZ-59 <br /> WHEREAS, Lynn Jansen has applied to rezone an approximately 3.0 acre <br /> portion of an existing approximately 4.0 acre parcel (APN 946-3477-001-00) from the A <br /> (Agricultural) zoning district to PUD-MDR (Planned Unit Development— Medium Density <br /> Residential) zoning district; and <br /> WHEREAS, based on the Initial Environmental Study, a Negative Declaration <br /> was adopted by City Council on July 19, 2011; and <br /> WHEREAS, at its meeting of July 19, 2011, the City Council received the <br /> Planning Commission's unanimous recommendation for approval of the rezoning; and <br /> WHEREAS, a duly noticed public hearing was held on July 19, 2011; and, <br /> WHEREAS, after review of the materials presented, the City Council determined <br /> that the rezoning is consistent with the General Plan adopted on July 21, 2009. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES THEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Approves the rezoning of an approximately three (3) acre portion of <br /> an existing approximately four (4) acre parcel (APN 946-3477-001-00) located at 1623 <br /> Cindy Way to PUD-MDR (Planned Unit Development— Medium Density Residential). <br /> Section 2. The Zoning Map of the City of Pleasanton dated April 18, 1960, on <br /> file with the City Clerk, designating and dividing the city into zoning districts is hereby <br /> amended by Zoning Unit Map No. 477, attached hereto as Exhibit A, dated July 19, <br /> 2011, and incorporated herein by this reference. <br /> Section 3. A summary of this ordinance shall be published once within fifteen <br /> (15) days after its adoption in "The Valley Times," a newspaper of general circulation <br /> published in the City of Pleasanton, and the complete ordinance shall be posted for <br /> fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption. <br /> Section 4. This ordinance shall be effective thirty (30) days after its passage <br /> and adoption. <br />
