BACKGROUND <br /> Tract 8064, Ironwood, is the third phase of the residential development proposed by <br /> Ponderosa Homes for their Active Adult development. The property is located on the <br /> north side of the Operations Services Center as shown on the attached vicinity map <br /> (Attachment 1). <br /> On April 15, 2009, the Planning Commission approved an application from Ponderosa <br /> Homes for a Vesting Tentative Map to subdivide an approximately 23.1-acre site <br /> located on Bradford Way (formally Reimers Drive). The Tentative map allows for the <br /> division of the site into 110 single-family home lots, plus four common area parcels. The <br /> Tentative Map is consistent with the PUD development plan for this site. <br /> After the approval of the Vesting Tentative Map in April 2009, the City Council approved <br /> Tract 8004 which included three residential lots and five large parcels for future sub- <br /> division. Subsequently, on September 15, 2009, City Council approved Tract 8023 a <br /> subdivision of lots 4, 6 and 7 of Tract 8004 which created forty residential lots. <br /> The Engineering staff, Planning staff, and the City Attorney's Office have reviewed the <br /> Final Map and other legal documents for Tract 8064. All submittals are in substantial <br /> conformance with the PUD and Tentative Map approvals. Development fees have been <br /> paid and a signed Subdivision Agreement has been submitted. <br /> DISCUSSION <br /> Proposed Improvements <br /> Tract 8064, the third phase of the Ironwood Development, includes the extension of <br /> Bingham Street, Felton Terrace, and Newport Street which were partially constructed <br /> with Tract 8004. Additionally, Chatham Place will be partially constructed with this <br /> phase. All the streets within the development are private and will be maintained by the <br /> Homeowners Association (HOA). <br /> The sanitary sewer and water systems within these private streets will be maintained <br /> and operated by the City. The streets, storm drain, landscaping and irrigation systems <br /> within the subdivision, will be maintained by the HOA. <br /> Discretion to Deny the Finai Map <br /> The approval of a Final Map when the Final Map substantially complies with the <br /> conditions of the Tentative Map is a mandatory, ministerial act (Government Code, <br /> Section 66474.1). Put another way, a Final Map shall be disapproved only for failure to <br /> meet conditions that were applicable at the time the Tentative Map was approved. If the <br /> Final Map is disapproved, there must be a finding identifying the conditions which were <br /> not met (Government Code, section 66473). <br /> Staff has reviewed the conditions of approval of the Tentative Map, and finds that all <br /> have been satisfied and that the Final Map complies with the conditions of the Tentative <br /> Map. <br /> Page 2 of 3 <br />
