WHEREAS, this City Council further finds that this project conforms to the requirements and purposes of the City's PUD ordinance, including its use for property which could have developed under the Hillside Planned Development ordinance, is in the best interests of the public health, safety, and general welfare, and is consistent with the goals and policies of the Pleasanton General Plan; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Finds the recitals herein contained are true and correct. Section 2: Approves the development plan for a 23 unit single- family residential project on approximately 48 acres, subject to the conditions on Exhibit "B" attached hereto and by this reference incorporated herein. Section 3: Approves the rezoning of an approximately 48 acre site located on the west side of Foothill Road, northwest of its intersection of Bernal Avenue from the HPD (Hillside Planned Development) District to the PUD (Planned Unit Development). Section 4: The Zoning Map of the City of Pleasanton dated April 18, 1960, on file with the City Clerk, designating and dividing the City into zoning districts is hereby amended by Zoning Unit Map #260, attached hereto as Exhibit "C" dated August 24, 1982, and incorporated herein by reference. Section 5: The City staff is directed to cause a Notice of Determination to be filed pursuant to Section 5.4(g) of Resolution No. 77-66. Section 6: This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton. Section 7: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
