Box 520 Pleasanton, CA 94566 Recording requested Pursuant to Government Code Sections 27383&8103 PREANNEXATION AND PROVISION OF WATER AND SEWERAGE FACILITIES AND SERVICE AGREEMENT THIS AGREEMENT is made this day of June 751, 2011 between the City of Pleasanton, a municipal corporation (City) and HDF Partnership, A General Partnership (Owner). RECITALS A. Owner is the owner of certain real property located on Linden Way (APN: 946- 1706-006-00, Pleasanton, CA, more particularly described in Exhibit A (the Exhibit A property)and incorporated herein by reference. B. Owner wishes to connect the Exhibit A property to the City sewer system in order to construct the proposed residence approved by Alameda County (PLN2011- 00014). C. Owner wishes to connect the Exhibit A property to the City water system in order to construct the proposed residence approved by Alameda County (PLN2011- 00014). D. Generally, City policy requires property to be annexed prior to extending such City services as water and sewer service. E. Owner is willing to annex the Exhibit A property either as part of a larger annexation or as part of a smaller annexation involving properties and other property contiguous to the City. F. The public health, safety, and welfare of the City's residents are well served by eliminating the need for water wells and septic tanks and by connecting to the City's water and sewer system. G. City is willing to extend its sewer and water services only if there are assurances that the property won't be further subdivided without approval of the City. NOW, THEREFORE, City and Owners hereby agree as follows: 1. Sewer and Water Service. Owner may connect to City's sewer and water systems prior to the City's annexation of the property upon the satisfaction of the following conditions: 1
