7. Approval of case PUD-82-1 is subject to Conditions <br /> 4 through 31, 33 through 50 and 57 of Exhibit "A", <br /> Conditions Attached to PUD-80-14, attached hereto <br /> and made part of this case by reference. <br /> <br /> 8. That the applicant be aware that there exists an overall <br /> fire hydrant location and on-site mains plan approved by <br /> the City Engineer and Fire Marshal. The subject project <br /> will be required to adhere to this plan. <br /> <br /> 9. That at the time deemed necessary by the City Engineer <br /> the applicant shall construct a driveway through the <br /> easternmosttip of the subject property between the <br /> Carnation Restaurant site and the Meyer property and <br /> aligned with the western driveway on the Carnation <br />. property. The purpose of this new driveway shall be to <br /> allow vehicular access between the ~eyer and Carnation <br /> properties. <br /> <br /> 10. That no structures on the property shall exceed 65 feet <br /> in height except to allow for elevator rooms if applicable. <br /> The 65 foot height limitation shall be measured from the <br /> ground level. <br /> <br /> 11. ~'hat since the development plan does not show the <br /> specific design of buildings, lot configuration, or <br /> other site development features to be constructed in <br /> Phase II, development of individual sites shall require <br /> review by the Planning Commission and City Council. <br /> <br /> 12. The applicant shall initiate and complete as soon as <br /> possible a review of feasibility of a redesign of the <br /> Johnson-Hop~ard intersection which would extend <br /> Johnson Drive into the subject property between the <br /> Denny's and Hungry Hunter restaurants. If, in the <br /> opinion of the City, it proves feasible to accomplish <br /> this redesign, the applicant shall endeavor to complete <br /> the redesign of the intersection and approaching street, <br /> with the assistance of the City and other property <br /> owners as necessary, in lieu of completing the Johnson <br /> Drive improvements required by Conditions 5-7 of PUD-80-14. <br /> The applicant acknowledges that if redesign is determined <br /> to be necessary, the circulation system, and other aspects <br /> of this PUD approval, shall require modification <br /> following hearings before the Planning Conmission and <br /> the City Council. <br /> <br /> 13. That all buildings and/or structures must comply with <br /> all codes and ordinances in effect at the time required <br /> permits are issued by the building division. <br /> <br /> <br />
