fathom any circumstance under which the Council would allow this downtown option and stated
that the City would use every option at its disposal to ensure it does not come to fruition. She
also agreed that the 580/680 option was more appropriate and warranted further consideration.
BREAK — Vice-Mayor Cook-Kallio called a brief break at 9:15 p.m., and thereafter reconvened
the regular meeting.
23. Continued from March 15, 2011 - Public Hearing: PAP-152 (PADR-2138), Frederic and
Yiping Leroudier, Appellant (Applicant) — Consider an appeal of the Planning
Commission's approval of an Administrative Design Review application to install a second-
story window on the right (south side) elevation of the existing residence located at 5252
Meadowwood Court. Zoning for the property is R-1-6,500 (One-Family Residential) District
Planning Manager Stern presented the staff report, and said the appeal relates to a condition of
approval imposed by the Planning Commission that requires installation of landscaping. The
required landscaping is intended to mitigate the privacy concerns, resulting from a proposal to
install a new south facing second-story window to an existing home, of the appellant's southern
neighbor.
Ms. Stern reviewed images of the existing residence's location and positioning relative to the
neighboring home. She noted that existing windows on the east side of the home are single
hung and do not meet current Building Code standards for egress, requiring any new window
placed in the bedroom to meet the egress requirements.
Councilmember McGovern asked and staff confirmed that it would be possible to satisfy egress
requirements with a retrofit to the existing windows. Chief Building Official Thomas confirmed,
noting that while the existing windows are retrofits themselves they were installed prior to
inspection requirements on window replacements.
Ms. Stern stated the Planning Commission heard and denied an appeal of the permit approval,
thereby upholding the Zoning Administrator's decision to allow the window. However, the
Commission modified the conditions of approval to require that the applicant install landscaping
on the site of a number and species to be selected by the Community Development Director.
Community Development Director Dolan consulted with the City's Landscape Architect
regarding the appropriate number and species of tree and recommended the installation of
three Italian Cypress or three Fern Pines adjacent to the proposed window. It was further stated
that should the trees grow sufficiently to the point that two trees would effectively screen the
area, the middle tree could be removed and the remaining trees trimmed or pruned to an
approximate height of 14 feet 6 inches. The applicant was not satisfied with the planting
requirements and filed an appeal of the Planning Commission's decision.
Vice-Mayor Cook-Kallio opened the public hearing.
Yiping Leroudier, appellant, stated that her family filed the permit application for a new window
to improve ventilation and optical conditions in her daughter's bedroom. She referred to
contractor and ophthalmologist's letters on file that attest to current conditions and said that
ample examples of similarly situated windows throughout the neighborhood. The Susanto's
objection cites privacy violations via their rear yard deck, family room, sliding door, and kitchen
window. Ms. Leroudier detailed the design, floor plan and positioning of the two homes as well
as the homes to the south and rear of the Susanto's. She noted the Susantos either overlook or
have a line of sight into the interior and exterior space of the three homes surrounding their
City Council Minutes Page 10 of 12 April 19, 2011
