RESOLUTION NO. 11-444 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING A <br /> GRANT APPLICATION FOR ASSEMBLY BILL 2286 <br /> WHEREAS. Assembly BIN AB 2286 (statutes 2008)went into effect January 1, 2009; and <br /> WHEREAS, AB 2286 requires all Certified Unified Program Agencies and business regulated <br /> under the Unified Program to report electronically by January 1, 2013; and <br /> WHEREAS, the California Constitution requires the state to reimburse local agencies for certain <br /> costs mandated by the state and compliance with AB 2286 reporting requirements will cause Certified <br /> Unified Program Agencies to incur additional costs; and <br /> WHEREAS, AB 2286 caused the Unified Program oversight surcharge to be increased by $25 <br /> each year for 3 years with not less than 75% of that funding to be provided to Certified Unified Program <br /> Agencies through grant funds; and <br /> WHEREAS, the Livermore-Pleasanton Fire Department is the Certified Unified Program Agency <br /> for the cities of Livermore and Pleasanton. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council authorizes the submittal of an Assembly Bill 2286, application to <br /> the Secretary of the California Environmental Protection Agency. <br /> SECTION 2. The Fire Chief, or his/her designee, is hereby authorized and empowered to <br /> execute in the name of the City of Pleasanton all documents, including but not limited to, applications, <br /> agreements, annual reports including expenditure reports and amendments necessary to secure said <br /> payments to support our Unified Program. <br /> SECTION 3. This authorization is effective until rescinded by City Council of the City of <br /> Pleasanton. <br /> SECTION 4. The City Clerk shall certify to the passage of this resolution and enter it into the <br /> book of original resolutions. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular <br /> meeting held on May 3, 2011. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing resolution <br /> was adopted by the City Council at a regular meeting held on the 3`d day of May, 2011, by the following <br /> vote: <br /> Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br /> Karen Diaz, City Clerk 3 <br /> APPROVED AS TO FORM: <br /> enathan P.
