Continued from March 15, 2011 - Public Hearing: PAP-152 (PADR-2138), Frederic and <br /> Yiping Leroudier, Appellant (Applicant) — Consider an appeal of the Planning <br /> Commission's approval of an Administrative Design Review application to install a second- <br /> story window on the right (south side) elevation of the existing residence located at 5252 <br /> Meadowwood Court. Zoning for the property is R-1-6,500 (One-Family Residential) District <br /> Planning Manager Stern presented the staff report, and said the appeal relates to a condition of <br /> approval imposed by the Planning Commission that requires installation of landscaping. The <br /> required landscaping is intended to mitigate the privacy concerns, resulting from a proposal to <br /> install a new south facing second-story window to an existing home, of the appellant's southern <br /> neighbor. <br /> Ms. Stern reviewed images of the existing residence's location and positioning relative to the <br /> neighboring home. She noted that existing windows on the east side of the home are single <br /> hung and do not meet current Building Code standards for egress, requiring any new window <br /> placed in the bedroom to meet the egress requirements. <br /> Councilmember McGovern asked and staff confirmed that it would be possible to satisfy egress <br /> requirements with a retrofit to the existing windows. Chief Building Official Thomas confirmed, <br /> noting that while the existing windows are retrofits themselves they were installed prior to <br /> inspection requirements on window replacements. <br /> Ms. Stern stated the Planning Commission heard and denied an appeal of the permit approval, <br /> thereby upholding the Zoning Administrator's decision to allow the window. However, the <br /> Commission modified the conditions of approval to require that the applicant install landscaping <br /> on the site of a number and species to be selected by the Community Development Director. <br /> Community Development Director Dolan consulted with the City's Landscape Architect <br /> regarding the appropriate number and species of tree and recommended the installation of <br /> three Italian Cypress or three Fern Pines adjacent to the proposed window. It was further stated <br /> that should the trees grow sufficiently to the point that two trees would effectively screen the <br /> area, the middle tree could be removed and the remaining trees trimmed or pruned to an <br /> approximate height of 14 feet 6 inches. The applicant was not satisfied with the planting <br /> requirements and filed an appeal of the Planning Commission's decision. <br /> Vice-Mayor Cook-Kallio opened the public hearing. <br /> Yiping Leroudier, appellant, stated that her family filed the permit application for a new window <br /> to improve ventilation and optical conditions in her daughter's bedroom. She referred to <br /> contractor and ophthalmologist's letters on file that attest to current conditions and said that <br /> ample examples of similarly situated windows throughout the neighborhood. The Susanto's <br /> objection cites privacy violations via their rear yard deck, family room, sliding door, and kitchen <br /> window. Ms. Leroudier detailed the design, floor plan and positioning of the two homes as well <br /> as the homes to the south and rear of the Susanto's.
