Any action brought against the city upon any claim or demand shall conform to <br /> the requirements of Sections 940 to 949 of the California Government Code. Any action <br /> brought against any employee of the city shall conform with the requirements of Sections <br /> 950 and 951 of the California Government Code. <br /> 1.04.100 Payment of taxes prior to refund or judicial relief. <br /> No legal or equitable process shall be issued in any proceeding in any court against the <br /> city or any officer of the city to prevent or enjoin the collection of any tax. After payment <br /> of a tax claimed to be illegal, not due and/or owing, and/or incorrectly calculated, an <br /> action may be maintained to recover the tax paid; provided, that prior to any judicial <br /> action all administrative remedies shall be exhausted. <br /> B. Amend Chapter 2.24 Fire Department, Sections 2.24.010 and 2.24.020 to read as <br /> follows: <br /> 2.24.010 Organization. <br /> The fire department of the city shall be formed, organized, operated and <br /> conducted under and in accordance with the joint agreement with the City of <br /> Livermore. It shall be known as "the Livermore-Pleasanton Fire Department" <br /> hereafter called "the fire department." <br /> 2.24.020 Firefighters—Generally. <br /> The fire department shall be operated and staffed as agreed upon with the City of <br /> Livermore by resolution adopted from time to time by the city council. <br /> C. Amend Chapter 9.08 Litter, Section 9.08.120 shall be amended to read as follows: <br /> 9.08.120 Placing handbills on vehicles. <br /> No person shall throw or deposit any commercial or noncommercial handbill in or <br /> upon any vehicle if such handbills create significant litter. <br /> D. Amend Chapter 9.14 Stormwater Management and Discharge Control as follows: <br /> (1) Amend Section 9.14.030 to read as follows: <br /> 9.14.030 Responsibility for administration. <br /> This chapter shall be administered for the city by the operations services director <br /> or his or her designee. Where storm drain facilities and/or watercourses have <br /> been accepted for maintenance by the Alameda County flood control and water <br /> conservation district (ACFCWCD) or other public agency legally responsible for <br /> certain watercourses, then the responsibility for enforcing the provisions of this <br /> chapter may be assigned to such agency (through contract or agreement <br /> executed by the city and such agency) with respect to those watercourses for <br /> which they have accepted maintenance. This chapter shall be construed to <br /> assure consistency with the requirements of the Federal Clean Water Act and <br /> acts amendatory thereof or supplementary thereto, applicable implementing <br /> regulations, and the City's current NPDES Permit and any amendment, revision <br /> or reissuance thereof. <br />
