CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 03-057 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION AMENDING THE MASTER FEE <br />RESOLUTION NO. 92-100 TO ADD A FEE FOR THE <br />STORAGE OF FIREARMS THAT ARE SUBJECT TO A <br />PROTECTIVE ORDER <br /> <br />on May 19, 1992, the City Council adopted Resolution No. 92-100 that established <br />a new Master Fee Schedule; and <br /> <br />Section 6389 (a) of the Califomia Family Code provides that a person subject to a <br />protective order, as defined in Section 6218 of the California Family Code, shall <br />not own, possess, purchase, or receive a firearm while that protective order is in <br />effect; and <br /> <br />Section 6389(e) of the California Family Code provides that law enforcement <br />agencies may charge an individual subject to a protective order a fee for the <br />storage of any firearm held pursuant to the protective order; and <br /> <br />Section 6389(e) of the Family Code provides that the storage fee shall be equal to <br />the actual cost incurred by the agency for the storage of the firearm; and <br /> <br />Section 6389(e) of the Family Code provides that the actual cost incurred by the <br />agency for the storage of a firearm includes all expenses directly related to taking <br />possession of the firearm, storing the firearm, and surrendering possession of the <br />firearm to a licensed dealer or to the individual subject to the protective order; and <br /> <br />the average administrative cost associated with the collection, storage and release <br />of each firearm held pursuant to Section 6389 of the Family Code is equal to <br />approximately $65; and <br /> <br />the City of Pleasanton is not recovering any cost for the collection, storage and <br />release of firearms pursuant to Section 6389 of the Family Code; and <br /> <br /> <br />
