RESOLUTION NO. 11-434 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, AUTHORIZING THE CITY ENGINEER TO ACCEPT FROM THE STATE OF CALIFORNIA, AND CONSENT FOR RECORDATION OF DEEDS AND GRANTS, THE PARCEL OF LAND TO BE USED FOR THE PUBLIC PURPOSE OF THE S -6 SANITARY SEWER PUMP STATION REPLACEMENT PROJECT WHEREAS, Section 27281, Government Code, State of California, provides that deeds or grants conveying any interest in or easement upon real estate to a political corporation or governmental agency for public purposes shall not be accepted for recordation without the consent of the grantee evidenced by its certificate or resolution of acceptance attached to or printed on the deed or grant; and WHEREAS, a political corporation or governmental agency, by a general resolution, may authorize one or more officers or agents to accept and consent to such deeds or grants; and WHEREAS, the construction, operation, and maintenance of improvements constructed for a public purpose necessitates the acquisition of right -of -way; and WHEREAS, the City Engineer is generally responsible to determine the property requirements for such improvements; and WHEREAS, it is in interests of convenience and efficiency to designate and authorize the City Engineer to accept deeds and grants. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The City Engineer is authorized to take action concerning the acceptance of, and consent for recordation of, deeds and grants of a satisfactory form, which convey the right, title, and interest in real property to the City of Pleasanton for a public purpose. SECTION 2. The City Engineer is authorized to execute a certificate of acceptance in substantially the following form: This is to certify that the interest in real property identified as parcel DD 046921 -01 -01 conveyed by the deed or grant dated June 1, 2011 from California Department of Transportation to City of Pleasanton, a municipal corporation, is hereby accepted by the undersigned City Engineer of the City of Pleasanton on behalf of the City Council pursuant to authority conferred by Resolution No. 11 -434 of the City Council adopted on April 19, 2011, and the grantee consents to recordation thereof by the City Engineer. SECTION 3. The authority conferred in the City Engineer by this resolution shall not be construed as an authority for the expenditure of funds for acquisition of a right, title, or interest in real property. SECTION 4. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.
