RESOLUTION NO. 11-441 A RESOLUTION DENYING CASE PAP -152, THEREBY UPHOLDING THE PLANNING COMMISSION'S APPROVAL OF THE APPLICATION OF FREDRIC AND PIPING LEROUDIER FOR AN ADMINISTRATIVE DESIGN REVIEW APPLICATION, AS FILED UNDER CASE PADR -2138 WHEREAS, Fredric and Yiping Leroudier applied for an Administrative Design Review application to install a second -story window on the right (south side) elevation of the existing residence located at 5252 Meadowwood Court; and WHEREAS, zoning for the property is R -1 -6,500 (One - Family Residential) District; and WHEREAS, within the time specified by the Pleasanton Municipal Code, Kong Susanto and Catharine Pranoto submitted an appeal of the Zoning Administrator approval to the Planning Commission; and WHEREAS, at its meeting of February 9, 2011, the Planning Commission, having considered all public testimony, relevant exhibits, and recommendations of City staff concerning this application, denied the appeal but amended the conditions of the Zoning Administrator's approval; and WHEREAS, within the time specified by the Pleasanton Municipal Code, Fredric and Piping Leroudier submitted an appeal of the decision of the Planning Commission to the City Council; and WHEREAS, at its meeting of April 19, 2011 the City Council received a report from the Director of Community Development, together with a copy of the staff report to the Planning Commission, regarding this matter; and WHEREAS, the City Council held a public hearing on April 19, 2011, at which time the appellants and any other member of the public were offered an opportunity to present evidence regarding the appeal; and WHEREAS, after a review of the materials presented, the City Council determined that, as conditioned, the proposed window would be appropriate for the site and would be consistent with the zoning regulations of the zoning district of the property. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. Denies the appeal, Case PAP -152, thereby upholding the decision of the Planning Commission approving Case PADR -2138, the application of Fredric and Yiping Leroudier for an Administrative Design Review application to install a second -story window on the right (south side) elevation of the existing residence located at 5252 Meadowwood Court, subject to the conditions shown on Exhibit A, attached hereto and made a part of this case by reference. SECTION 2. This resolution shall become effective immediately upon its passage and adoption.
