CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 03-027 <br /> <br />RESOLUTION INITIATING PROCEEDINGS FOR THE <br />FORMATION OF THE LEMOINE PROPERTY GEOLOGIC <br />HAZARD ABATEMENT DISTRICT (GHAD) <br /> <br />WHEREAS, <br /> <br />on October 18, 1994, pursuant to Section 26550 of the Public Resources Code, this <br />Council adopted Resolution No. 94-118A, declaring that the Council is subject to <br />the provisions of Division 17 (§26500 et seq.) of said Code; and <br /> <br />WHEREAS, <br /> <br />a petition was filed with the City Clerk, dated November 16, 2000 for the <br />formation of a Geologic Hazard Abatement District ("GHAD") for the LeMoine <br />property project area; and <br /> <br />WHEREAS, <br /> <br />said petition complies with the provisions of the Public Resources Code §26552 <br />and has attached to it a legal description of the boundaries of the territory to be <br />included within the proposed GHAD (Exhibit "A"), a map showing the boundaries <br />of the territory to be included within the proposed GHAD (Exhibit "B") and a plan <br />of control (Exhibit "C"); and <br /> <br />WHEREAS, <br /> <br />the City Clerk has received said petition and determined that it is substantially in <br />the form described in the Public Resource Code §§26551, 26552 and 26553, and <br />verified that the signature affixed to the petition represents the owner of all of the <br />real property to be included within the proposed GHAD, and further verified that <br />the signatures thereon were secured within 120 days of the date on which the first <br />signature on the petition was affixed and that said petition was submitted to the <br />City Clerk within 30 days after the last signature was affixed. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br />Section 2: <br /> <br />This resolution is made pursuant to Division 17 (§26500 et seq.) of the Public <br />Resources Code. <br /> <br />The City Council has been presented with and has reviewed the plan of control <br />submitted with the petition for the proposed GHAD, and has determined that the <br />public health, safety and welfare require formation of the GHAD. <br /> <br /> <br />
