CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> ORDINANCE NO. 1881 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF NEW CITIES <br />DEVELOPMENT GROUP FOR A MAJOR MODIFICATION TO AN <br />APPROVED PLANNED UNIT DEVELOPMENT, AS FILED UNDER <br />CASE PUD-97-12-3M <br /> <br />WHEREAS, <br /> <br />New Cities Development Group applied for a modification to an approved PUD <br />Plan to allow an extension of a planned unit development (PUD-97-12) for parcels <br />20 and 23, located within the North Sycamore Specific Plan Area; and <br /> <br />WHEREAS, The Zoning Administrator approved a minor modification to the PUD to extend <br /> the approval of the PUD development plan to May 1, 2003; and <br /> <br />WHEREAS, <br /> <br />The City Council appealed the Zoning Administrator's action, then subsequently <br />continued the matter, with the applicant's consent, while discussion ensued <br />concerning reinstatement of a prior agreement relative to the Happy Valley <br />infrastructure; and <br /> <br />WHEREAS, <br /> <br />the City staff and the applicant have reached agreement on all issues, but now <br />require the approval of the final map for the project to be delayed until late <br />summer of 2003; and <br /> <br />WHEREAS, Vesting Tentative Map 7193, the project's tentative map, would expire on March <br /> 20, 2003 without an extension; and <br /> <br />WHEREAS, the City Council may extend the timeframes for both the PUD development plan <br /> and vesting tentative map approvals; and <br /> <br />WHEREAS, <br /> <br />projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, a duly noticed public hearing was held on March 18, 2003; and <br /> <br />WHEREAS, the City Council finds that the proposed modifications are appropriate. <br /> <br /> <br />
