Option 3: Deny the appeal and approve the project as conditioned by the Planning <br />Commission, including the landscaping determined by the Director of <br />Community Development as follows: <br />• The Leroudiers shall install three Italian Cypress trees, planted <br />three -feet on center, adjacent to the new window. Should the <br />two end trees grow such that their branches intertwine <br />sufficiently to provide an adequate screen, the center tree can be <br />removed. The trees can be "topped" or pruned such that they do <br />not exceed a height of 14 -feet, six - inches. <br />Option 4: Deny the appeal and approve the project with new and /or modified <br />conditions. Modified conditions could include: <br />a. Revise the landscape screening condition to require the <br />applicants to install two Podocarpus gracilior — Fern Pine trees or <br />Pittosporum eugenioides instead of three cypress trees. <br />b. Eliminate the landscape screening condition, require the <br />applicants to modify the eastern window(s) to meet egress <br />requirements, and allow the applicants to install one or more <br />windows on the southern elevation with a minimum sill height of <br />6 feet from the second story finished floor. <br />c. Eliminate the landscaping requirement and require the applicant <br />to utilize view - obscuring glass (e.g., frosted, etched, etc.) for the <br />new window. In addition to this, require that a restrictive <br />covenant be recorded against the property to ensure that future <br />property owners are aware of the requirement. Staff notes that <br />the window would need to be operable to meet egress <br />requirements and privacy would be reduced when the window <br />was open. <br />PUBLIC NOTICE <br />Notices regarding this appeal and related public hearing were mailed to the surrounding <br />property owners and tenants within a 1000 -foot radius of the project site. At the time <br />this report was prepared staff has not received any additional comments or concerns. <br />Staff has, however, included public correspondence received during the Planning <br />Commission hearing for the Council's consideration (Attachment 4). <br />ENVIRONMENTAL ASSESSMENT <br />A minor alteration to an existing structure that does not expand the use is categorically <br />exempt (Existing Facilities) from the California Environmental Quality Act (CEQA). <br />Therefore, no environmental documentation accompanies this report. <br />Page 7 of 8 <br />
