RESOLUTION NO. 11-432 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RATIFYING THE CITY MANAGER'S PROCLAMATION OF THE EXISTENCE OF A <br /> LOCAL EMERGENCY DUE TO THE LANDSLIDE ON PLEASANTON RIDGE <br /> BREAKING • A WATER MAIN SERVING 250 HOMES, DEPRIVING THEM OF <br /> POTABLE WATER AND FIRE HYDRANT SERVICE, WHICH CREATED AN <br /> IMMEDIATE DANGER TO PERSONS AND PROPERTY <br /> WHEREAS, on March 25, 2011, a landslide on the Pleasanton Ridge broke a City water <br /> main serving 250 homes, depriving them of potable water and fire hydrant service, creating an <br /> immediate danger to persons and property; and <br /> WHEREAS, responding City staff recognized the nature, location and size of the <br /> landslide made it impossible to make an immediate repair of the water line, such that the 250 <br /> residents would remain without potable water service or fire hydrant service; and <br /> WHEREAS, based on this immediate and ongoing danger to persons and property, the <br /> City Manager, acting as Director of Emergency Services, declared a local emergency on March <br /> 25, 2011 pursuant to the authority granted by Municipal Code section 2.44.060, as the City <br /> Council was not in session to declare the local emergency itself; and <br /> WHEREAS, this same Municipal Code section requires that the City Council ratify the <br /> proclamation within seven (7) days thereafter; and <br /> WHEREAS, the City Council does hereby find that the above described conditions of <br /> immediate danger to persons and property warranted and necessitated the proclamation of the <br /> existence of a local emergency in the City of Pleasanton. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> Section 1: That the "Proclamation of the Existence of a Local Emergency" as issued <br /> by the City Manager on March 25, 2011 is hereby ratified and confirmed. <br /> Section 2: That the local emergency shall be deemed to continue to exist until its <br /> termination is proclaimed by the City Council of the City of Pleasanton. <br /> Section 3: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a special meeting held on March 31, 2011. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, certify that the foregoing resolution <br /> was adopted by the City Council at a special meeting held on the 31 day of March 2011, by the <br /> following vote: <br /> Ayes: Councilmembers Cook- Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br />
