He stated that he does not agree that people stand in their windows to <br />look at other people's rear yards and added that the applicants' daughter will most likely <br />be off to college before the trees grow. <br />Commissioner O'Connor stated that it is common that people can see into each other's <br />backyards, and the appellants themselves can stand on their own deck and look into the <br />applicants' yard. He added that putting in large trees would defeat the purpose of the <br />window as the trees would block the sunlight from coming into the room. <br />Commissioner Blank said there is a process and the Commission has the ability to <br />adjudicate through that process. <br />Commissioner O'Connor agreed but stated that he does not see this as something out <br />of the ordinary with what many other homes already have. <br />Commissioner Blank asked Commissioner O'Connor whether he would support denying <br />the appeal. <br />Commissioner O'Connor said yes. He added that he sees this as a way where staff <br />was looking for compromise and none has been reached. <br />Commissioner Blank stated that he also supported denying the appeal with conditions <br />as specified in Exhibit A of the staff report. <br />Commissioner Pentin stated that he has listened to both sides, read emails and letters, <br />and thinks the goal is always to have neighbors go away being happy, but he sees no <br />movement. He indicated that he is inclined to deny the appeal with the conditions as <br />specified in Exhibit A of the staff report. <br />Commissioner Pentin moved to deny the appeal, thereby upholding the Zoning <br />Administrator's decision, subject to the Conditions of Approval as listed in <br />Exhibit A of the staff report. <br />Commissioner Blank seconded the motion, with an amendment that Condition <br />No. 2 to be modified to indicate that the choice of the tree species, their number, <br />and their location shall be at the discretion of the Director of Community <br />Development. <br />Commissioner Pentin noted that the landscape architect recommended the trees and <br />believed that some thought went into this. <br />Commissioner O'Connor commented that this is one of the reasons why he did not like <br />the condition because by the time a tree is planted that will grow large enough to block <br />the view from the window to a yard, it will also defeat the purpose of letting in the <br />sunlight. <br />DRAFT EXCERPT: PLANNING COMMISSION MINUTES, February 9, 2011 Page 7 of 8 <br />
