RESOLUTION NO. 11 -421 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, APPROVING A NEGATIVE DECLARATION FOR THE CITY- INITIATED MAJOR MODIFICATION TO THE PLANNED UNIT DEVELOPMENT FOR HACIENDA BUSINESS PARK TO ADOPT HACIENDA TOD STANDARDS AND DESIGN GUIDELINES AS FILED UNDER CASE PUD-81-30-48M/PUD-85-821M WHEREAS, at its meeting of February 15, 2011, the City Council received a proposed Negative Declaration for the City- initiated application for a Major Modification of the PUD for three sites in Hacienda Business Park as follows: (1) The W.P. Carey site at the southeast corner of Owens Drive and Willow Road (Assessor's Parcel No. 941 - 2778 - 013 -00); (2) The BRE site at the north corner of Hacienda Drive and Gibraltar Drive (APN 941 - 2778 - 011 -00); and (3) The Roche Molecular Systems site, south of Gibraltar Drive between Willow Road and Hacienda Drive (a portion of APN 941 - 2761 - 003 -00) to adopt Hacienda TOD Standards and Design Guidelines for mixed use and residential development; and WHEREAS, the City Council received and reviewed the Initial Study, dated January 25,2011, and received the recommendation of the staff and Planning Commission; and WHEREAS, a duly noticed public hearing was held on February 15, 2011, at which time the public was given the opportunity to comment on the environmental impacts of the proposed project; and WHEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Negative Declarations and Environmental Impact Reports and WHEREAS, the City Council finds that the proposed Major Modification to the PUD would not have any significant adverse effects on the environment; and WHEREAS, the City Council finds that the proposed Major Modification to the PUD will have no potential for adverse impacts on the state's wildlife. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Approves the Negative Declaration for PUD- 81- 3048M/PUD- 85 -821M to adopt the Hacienda TOD Standards and Design Guidelines. SECTION 2. The City staff is directed to cause a Notice of Determination to be filed pursuant to Section 5.4(g) of Resolution No. 77 -66. SECTION 3. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on February 15, 2011.
