CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1201 <br /> <br /> ORDINANCE ELECTING TO RECEIVE LICENSE FEE ON HORSERACING <br /> EVENTS WITHIN THE CITY OF PLEASANTON <br /> <br />WHEREAS, Business and Professions Code Section 19610.3 authorizes <br /> cities to elect to receive a specified percentage of <br /> total parimutuel wagers from horseracing events within <br /> their jurisdiction ("License Fee"); and <br /> <br />WHEREAS, if the City does not elect to receive said License Fee, <br /> then the amount deducted shall be paid by the Alameda <br /> County Agricultural Fair Association to the State of <br /> California as an additional License Fee; and <br /> <br />WHEREAS, a city which elects to receive said License Fee shall <br /> not thereafter assess or collect with respect to an <br /> event conducted by the racing association, any license <br /> or excise tax or fee including, but not limited to, any <br /> admission, parking, or business tax, or any tax or fee <br /> levied solely upon the racing association conducting a <br /> racing meeting or any racing patron; and <br /> <br />WHEREAS, any city electing to receive the License Fee shall <br /> continue to provide ordinary and traditional municipal <br /> services, such as police services and traffic control, <br /> in connection with racing meetings. "Ordinary and <br /> traditional municipal services" means those services <br /> provided at no charge by the City of Pleasanton to the <br /> Alameda County Agricultural Fair Association for horse <br /> racing events in 1981. The City Council hereby finds <br /> that the City charged the Alameda County Agricultural <br /> Fair Association for sewer service in 1981; and <br /> <br />WHEREAS, the City of Pleasanton charged an in lieu business <br /> license tax based upon the number of track patrons prior <br /> to January 1, 1984 as required by the statute; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: The City of Pleasanton hereby elects to receive 0.33 <br /> of one percent (0.33%) of the total parimutuel wagers <br /> placed within the enclosure of the Alameda County <br /> Agricultural Fair Association racing events. <br /> <br />Section 2: This ordinance is declared to be an urgency <br /> ordinance. The urgency is based on the fact that if <br /> this ordinance does not take effect prior to June 15, <br /> 1985 then the City of Pleasanton and the Alameda County <br /> Agricultural Fair Association will not be able to take <br /> <br /> <br />
