PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2002-73 <br />RESOLUTION DENYING CASE PAP-39, THEREBY APPROVING CASE PDR-191, <br />THE APPLICATION OF CINGULAR WIRELESS FOR DESIGN REVIEW <br />WHEREAS, on September 30, 2002, the Zoning Administrator approved the application of <br />Cingulaz Wireless for design review approval to allow the construction of six <br />wireless communication panel antennas and related equipment on the roof of an <br />existing building located at 3875 Hopyard Road; and <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development - <br />Industrial/Commercial-Office) District; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, a property owner in a <br />neighboring residential subdivision submitted an appeal to the City of Pleasanton; <br />WHEREAS, at its duly noticed public hearing of November 25, 2002, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission determined that the proposed wireless communication <br />antennas and related equipment adhere to the requirements of the Pleasanton <br />Municipal Code and that the proposed facility would create minimal impacts on <br />the nearby residences. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Denies Case PAP-39, thereby approving Case PDR-191, the application of Cingulaz <br />Wireless for design review approval to allow the constmction of six wireless <br />communication panel antennas and related equipment on the roof of an existing <br />building located at 3875 Hopyard Road, subject to the conditions shown in Exhibit <br />"B," attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
