BACKGROUND <br /> Mr. Churka requests that the City amend the Pleasanton Municipal Code to allow limited <br /> public storage within the "unused" basement space of his commercial building. Zoning <br /> Code amendments, such as this, cannot be site specific (i.e., 780 Main Street) and <br /> require amending specific zoning districts. In this instance, allowing basement storage <br /> for the public would require amending the Central Commercial (C -C) district in the <br /> Downtown area only. Accordingly, Mr. Churka applied for a zoning Code amendment to <br /> allow basement storage for the public as a permitted use within Downtown, C -C district <br /> (Please see Attachment 2). <br /> PROJECT DESCRIPTION <br /> The proposed redline amendments in Attachment 1 would amend the PMC which would <br /> modify Sections 18.08 Definitions, 18.44.090 Permitted and conditional uses, and <br /> 18.88.030 Schedule of off - street parking space requirements. These proposed Code <br /> amendments would allow businesses and /or individuals, which are not associated with <br /> the building or its uses, to rent commercial basement space within buildings located <br /> within the Downtown, Central Commercial zoning district only. <br /> DISCUSSION <br /> Prior to allowing public storage within a commercial basement space, the building owner <br /> would be required to demonstrate, to the satisfaction of the Community Development <br /> Department and the Livermore- Pleasanton Fire Department (LPFD), that the basement <br /> space is adequately constructed to allow storage and that the space meets access and <br /> operational requirements, wall separation, sprinkler systems, etc. of the California <br /> Building and Fire Codes. Furthermore, storage items would be limited to non- <br /> hazardous materials only, as classified by the LPFD. <br /> The performance standards outlined below would allow the Community Development <br /> Department to ensure that 1) there is adequate parking, 2) the space meets all <br /> applicable Building, Fire, and Zoning Codes, and 3) basement storage for public use <br /> would not be disruptive to adjacent uses. Therefore, staff proposes the following text <br /> amendments. <br /> Definition (18.08.057 Definitions) <br /> The following definition is intended to clarify the meaning of commercial basement <br /> storage. <br /> 18.08.057 Basement commercial storage _ public. <br /> "Basement commercial storage _public" means storage space located in the <br /> basement of any com nercial building that is made available to the public. <br /> Proposed Standards <br /> Staff proposes the following standards be met as a part of the amended Code <br /> (18.44.090 Permitted and conditional uses and 18.88.030 Schedule of off - street parking <br /> space requirements). Basement storage for the public in conformance with these <br /> standards would then be a permitted use in the Central Commercial (C -C) zoning <br /> district. <br /> Page 2 of 4 <br />
