The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. Given the proposed occupancy and hours of operation for the subject use, the proposed use will have adequate off-street parking to meet project demand and would not adversely impact the adjacent tenants. The proposed use is to be operated entirely indoors, and learning center activities should not interfere with adjacent uses. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. The site's PUD zoning conditionally permits the establishment of schools. Granting a conditional use permit to the applicant for a learning center is consistent with the City's ability to regulate zoning as listed in the Municipal Code Chapter 18.124, "Conditional Uses." WHEREAS, the Planning Commission determined that the proposed learning center will be compatible with the surrounding businesses and will not detrimentally affect the surrounding uses or properties. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case PCUP-62, the application of the Huntington Learning Center for a conditional use permit to operate a private school/tutorial services in an existing building located at 4855 Hopyard Road, Suite C3, in the Gateway Square Shopping Center, subject to the conditions shown in Exhibit "B," attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
