The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />Given the proposed occupancy and hours of operation for the subject <br />use, the proposed use will have adequate off-street parking to meet <br />project demand and would not adversely impact the adjacent tenants. <br />The proposed use is to be operated entirely indoors, and learning <br />center activities should not interfere with adjacent uses. <br />The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br />The site's PUD zoning conditionally permits the establishment of <br />schools. Granting a conditional use permit to the applicant for a <br />learning center is consistent with the City's ability to regulate zoning <br />as listed in the Municipal Code Chapter 18.124, "Conditional Uses." <br />WHEREAS, the Planning Commission determined that the proposed learning center will <br />be compatible with the surrounding businesses and will not detrimentally <br />affect the surrounding uses or properties. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-62, the application of the Huntington Learning Center <br />for a conditional use permit to operate a private school/tutorial services in an <br />existing building located at 4855 Hopyard Road, Suite C3, in the Gateway <br />Square Shopping Center, subject to the conditions shown in Exhibit "B," <br />attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON ON THE 28TH DAY OF AUGUST 2002 BY THE FOLLOWING <br />VOTE: <br />AYES: Commissioners Kameny, Maas, and Sullivan <br />NOES: None <br />ABSENT: Commissioners Arkin and Roberts <br />ABSTAIN: None <br />
