Resolution No. PC-2002-52 <br />Page 2 <br />2. The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />Vehicular access is provided from Bernal Avenue and Valley Avenue. <br />The intersection of Bernal Avenue with Valley Avenue is completely <br />signalized, permitting complete right-turn, left-turn, and through <br />movements. A pedestrian connection is provided to the residential <br />properties on Whispering Oaks Way. A noise analysis provided with the <br />proposal shows that noise levels from the carwash will not exceed ambient <br />noise levels at the project property lines and, therefore, would not impact <br />nearby properties. Adequate parking is provided for employees and <br />customers. <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br />The proposed conditional use is required to comply with all applicable <br />sections of the Pleasanton Municipal Code and with the Bernal Properties <br />Specific Plan and PUD governing the subject property. By complying <br />with the recommended conditions of approval, the proposed facility would <br />meet the criteria for receiving a conditional use permit and would, <br />therefore, comply with the intent of the Pleasanton Municipal Code, <br />Bernal Properties Specific Plan, and PUD development plan. <br />WHEREAS, the Planning Commission determined that the proposed conditional use is <br />appropriate for the site. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-61, the application of Bernal Partners, L.L.C. for a <br />conditional use permit for a proposed self-service gasoline station, <br />convenience market (including alcoholic beverage sales), and quick-service <br />restaurant with drive-through lane and drive-through carwash on an <br />approximately 1.3-acre site located at 1875 Valley Avenue (southeast corner <br />of Bernal Avenue and the Valley Avenue extension), subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case <br />by reference. <br />Section 2. This resolution shall become effective immediately upon its passage and <br />adoption. <br />
