PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-2002-47 RESOLUTION APPROVING SUSPENSION OF THE CONDITIONAL USE PERMIT FOR A DANCE CLUB AND BAR (NISUS ENTERTAINMENT D.B.A. THE MARQUE), AS FILED UNDER CASE UP-95-20 WHEREAS, on May 10, 1995, the City of Pleasanton Planning Commission approved a conditional use permit to establish a dance club and sports baz serving alcohol after 10:00 p.m., located at 4555 Hopyazd Road, Suite C-19; and WHEREAS, the property is zoned PUD-I/C-O (Planned Unit Development - Industrial/Commercial-Office) District; and WHEREAS, due to numerous complaints from surrounding residential neighbors, the conditional use permit was reviewed by the Planning Commission for consideration of possible modification or revocation; and WHEREAS, at its duly noticed public heazing of July 24, 2002, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this application; and WHEREAS, the Planning Commission determined that it would be appropriate to suspend the conditional use permit and reevaluate the matter at the Commission's first meeting in September 2002. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves the suspension of the conditional use permit to establish a dance club and sports bar serving alcohol after 10:00 p.m., located at 4555 Hopyazd Road, Suite C-19, as filed under Case UP-95-20. Section 2. Agrees to reevaluate the suspension of the conditional use permit at its first meeting of September 2002. Section 3. This resolution shall become effective I S days after its passage and adoption unless appealed prior to that time.
