forwazd with construction of the improvements or (ii) all necessary grants <br />of Vineyazd Avenue right-of--way are not obtained by the City. <br />IV. Construction of Improvements. <br />A. In the event PG&E facilities precede construction of the roadway <br />improvements, City shall ensure that the full roadway rough grading shall <br />be completed in conjunction with the PG&E project. <br />B. The City agrees to fund construction of the roadway improvements and <br />associated utilities listed in Exhibit C (the "Phase 1 Improvements"). The <br />City shall make good faith efforts to ensure the timely construction of <br />these improvements insofar as it is within its power to do so. The intent of <br />the parties is to have these improvements completed by September 1, <br />2003. <br />C. Phase II and Phase III improvements will be constructed in accordance <br />with the Specific Plan and conditions of approval. The funding of these <br />improvements is described in the Finance Plan, a copy of which is <br />attached as Exhibit D. <br />V. Vested Development Approvals. <br />A. The Property Owner shall be vested with the right to develop the Property <br />in accordance with and subject to the terms and conditions of the Specific <br />Plan and existing Project approvals.
