III. Dedication ofRight-of--Way and Easements. <br />A. Property Owner agrees to dedicate the following interests in real property <br />as shown in Exhibit B: <br />(1) Roadway right-of--way for the construction of the realigned <br />Vineyazd Avenue; <br />(2) Temporary construction easements around the above-described <br />lands as shown on Exhibit B, to last until the improvements have <br />been accepted by the City. <br />B. All rights-of--way and easements shall be granted within 15 days of <br />Property Owner's receipt of request for same by the City's Director of <br />Public Works, who is hereby empowered to accept and record such grants. <br />C. The Director of Public Works shall request the dedications only in the <br />event: <br />(1) PG&E gives notice to the City that it intends to build its 230KV <br />transmission line in the realigned Vineyazd Avenue and is moving <br />forwazd with construction; and <br />(2) the City has given its final authorization to constructing the <br />realigned Vineyard Avenue and associated improvements. <br />D. If the Property Owner transfers the property for the right-of--way and/or <br />grant easements, the City shall, at the request of Property Owner, take <br />such steps as may be necessary to return said property and/or easements to <br />Property Owner in the event that (i) neither PG&E nor the City move <br />Revision #3, Draft Hahner Development Agreement Page 7 of 17 <br />
