If any provision(s) of this Development Agreement is (are) held <br />invalid, the remainder of this Development Agreement shall not be affected and <br />shall remain in full force and effect. <br />XIII. Entire Agreement. This Development Agreement, including the Recitals and <br />Exhibits, constitute the entire understanding and agreement of the parties with <br />regard to the subject matter contained herein. <br />XIV. Warranty of Capacity to Execute. Each party warrants that the undersigned has <br />the capacity and authority to sign this Development Agreement on its behalf. <br />XVI. Effective Date. This Development Agreement was adopted by the City Council <br />of the City pursuant to Ordinance No. which became effective thirty (30) <br />days thereafter.
