Resolution No. PC-2002-31 <br />Page 2 <br />WHEREAS, at its duly noticed public hearing of May 14, 2002, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, an EIR was certified for the Specific Plan and additional CEQA review <br />was completed for subsequent land use reviews, no further CEQA review <br />was required; and <br />WHEREAS, the Planning Commission finds that these development agreements aze <br />consistent with the General Plan and the Vineyazd Corridor Specific Plan. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of the draft development agreements with the <br />following property owners, attached hereto and incorporated herein by this <br />reference: <br />1. Frank and Bazbaza Berlogaz <br />2. Kenneth R. and Pamela L. Chrisman <br />3. Data Sales of California <br />4. Wayne C. Hahner <br />5. Robert and Sharen Heinz <br />6. Brian C. Lin <br />7. Lonestaz California, Inc. <br />8. Mazdel, LLC <br />Section 2. The Planning Commission's recommended approval is subject to the <br />following: <br />1. City Staff shall ask the Pleasanton Unified School District for an update <br />or some assurance that it still wants to go forwazd with the construction <br />of the Vineyard Corridor elementary school as soon as possible (this <br />information shall be provided to the City Council prior to the Council <br />acting on this matter); <br />2. the City Finance Department shall look at a worst case scenario as it <br />pertains to additional costs to the City as a result of interest payments on <br />bonds or certificates of participation; <br />3. a section shall be added to the development agreements requiring that the <br />documents be recorded with the County; and <br />4. the City shall explore any options to prevent PG&E from installing the <br />230KV line on old Vineyard Avenue in the event that the development <br />agreements aze not approved or the new road is not constructed. <br />Section 3. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
