PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2002-31 <br />RESOLUTION RECOMMENDING APPROVAL OF THE DEVELOPMENT <br />AGREEMENTS WITH PROPERTY OWNERS WITHIN THE VINEYARD <br />AVENUE CORRIDOR <br />WHEREAS, Government Code Section 65865 through Section 65869.5 authorizes <br />cities and counties to enter into binding development agreements with <br />persons having legal or equitable interests in real property for the <br />development of such property; and <br />WHEREAS, in 1999 the Vineyazd Avenue Corridor Specific Plan was adopted by the <br />City of Pleasanton, specifying the right-of--way for a relocated Vineyard <br />Avenue and the core infrastructure necessary to support development of an <br />elementary school and 189 new residential units; and <br />WHEREAS, development plans for various properties have been processed to varying <br />degrees of completeness, from submittal of PUD development plans <br />through approval of tentative maps as follows: <br />1. Berlogar -PUD-O5, approved. <br />2. Chrisman -PUD-O5, approved <br />3. Hahner -PUD-01 Nesting Tentative Tract Map 7240, approved <br />4. Heinz -PUD-14, submitted <br />5. Lin -PUD-06, approved; Vesting Tentative Tract Map 7385, <br />submitted <br />6. Mardel, LLC -PUD-99-06, 99-08, 99-09, 99-10, 99-12; Vesting <br />Tentative Tract Map 7160, 7161, 7481, 7482, 7501, approved <br />7. Data Sales of California -PUD-O1Nesting Tentative Tract Map <br />7240, approved <br />8. Lonestaz California, Inc. -PUD-06, approved; Vesting Tentative <br />Tract Map 7385, submitted; and <br />WHEREAS, the above-listed property owners sought development agreements with the <br />City of Pleasanton to vest these land use entitlements in exchange for eazly <br />dedication ofrights-of--way and easements to allow early construction of <br />some of the core infrastructure benefiting the City of Pleasanton and the <br />Pleasanton Unified School District and eventual completion of a payment <br />for the core infrastructure in accordance with the Specific Plan; and <br />
