CONDITIONS OF APPROVAL <br /> PUD-85-1 <br /> <br />1. That the development shall be substantially as shown on the <br /> development plan, Exhibit A, on file with the Planning <br /> Department. <br /> <br />2. That the developer shall remove all English Walnut trees <br /> along the Mohr Avenue frontage of the subject property and <br /> replace them with minimum 24" box trees acceptable to the <br /> City staff. <br /> <br />3. That approval of the development plan for case PUD-85-1 <br /> constitutes approval for both phases of development even <br /> though Phase 2 may not follow for several years. <br /> <br />4. That no on-site or off-site grading shall take place on the <br /> subject property without prior City approval. <br /> <br />5. That no improvement activities, including but not limited to <br /> grading, construction, tree removal or site preparation shall <br /> be initiated until all proper City permits have been <br /> obtained. <br /> <br />6. That the design of the 6 ft. high masonry wall shown along <br /> the Southern Pacific Transportation Company right-of-way and <br /> along Mohr Avenue adjacent to the attached single family <br /> residences shall be submitted to the Planning Department for <br /> approval prior to approval of the tentative map. <br /> <br />7. That where the setback of any garage is less than 23 ft., <br /> roll-up type garage doors shall be used. <br /> <br />8. That the development shall be subject to the siting standards <br /> shown on page 3 of the development plan. Except as otherwise <br /> established by the conditions of approval of case PUD-85-1, <br /> the uses and site standards for the detached single-family <br /> residential portion of the project shall be those of the <br /> R-1-7500 District and the uses and site standards of the <br /> paired single-family residential portion shall be those of <br /> the RM-4000 District. <br /> <br />9. That final elevations for all paired single-family residences <br /> shall be submitted to the Planning Department for approval <br /> prior to issuance of any building permits. <br /> <br />10. That a homeowners association comprised of owners of the <br /> paired single-family residences shall be established for <br /> maintenance of all commonly owned areas and that the CC&Rs of <br /> the development shall be submitted to the City for approval <br /> prior to submittal of a final map. That the City shall be <br /> named as third party beneficiary of the CC&Rs and granted the <br /> <br /> EXHIBIT B <br /> <br /> <br />
