r Commissioner Arkin supported the motion. He indicated that he appreciated Toby's bringing its
business to the Downtown to fill a need for the 30- to 40-year-old age group and hoped that a
solution can be found to make things work. He stated that he had heard enough evidence from
the community to determine that things were getting out of hand. He commented that
double-paned windows did not help and that neighbors have the right to be able to go to bed at a
reasonable time without a lot of noise. He noted that staff did a good job to work the issue and
came up with the best solution.

Commissioner Sullivan thanked the staff and Commissioner Roberts for their work.

Commissioner Roberts agreed with Commissioner Arkin that this is something that the
community needs for its 30- to 40-year-olds.

ROLL CALL VOTE

AYES:
NOES:
ABSTAIN:
ABSENT:

Commissioners Arkin, Kameny, Maas, Roberts, and Sullivan
None
None
None

Resolution No. PC-2002-72 was entered and adopted as motioned.

--

e.

Review of the (1) 2002 Growth Manal!:ement Report: (2) future years' annual
allocations; and (3) future years' maior projects and first-come. first-served
sub-allocations: and consideration of the requests by Ponderosa Homes.
