The applicant concurred <br />with those conditions of approval. <br /> <br />Mr. Pavan noted that the Commission commented on the types of sundries that would be <br />provided. He noted that the goods carried would be closer to that carried by Trader Joe's, <br />and added that staff believes the products to be carried met the concerns expressed by the <br />Commission. Staff was comfortable that the applicant would live up to that promise. He <br />noted that the applicant had proceeded diligently to contact non-traditional restaurants, <br />such as Noah's Bagels, Starbucks, Peet's Coffee, and so forth. Although fast food <br />restaurant is a permitted use in this project, the applicant was pursuing more non- <br />traditional restaurant uses in accordance to the Commission's concerns. <br /> <br />Mr. Pavan noted that the carwash' s proposed hours of operation of 6 a.m. to 9 p.m. are <br />supported by staff. Staff conducted a noise analysis of the carwash, based upon the event <br />of the drier mechanism, not a 24-hour day-night average. From the entrance to the <br />Kaufman & Broad homes, the sound level will be 62 decibels for the event. The ambient <br />noise, based upon the noise report done in the Bernal Properties' EIR, was between 65 to <br />70 decibels LDN, or approximately 67 decibels as estimated by staff. Staff has placed <br />condition stating that when further analysis will be performed to ensure compliance, as <br />well as a requirement for an annual noise analysis for the carwash. <br /> <br />-- <br /> <br />In response to an inquiry by Commissioner Kameny, Mr. Pavan replied that staff was <br />asking for the noise reduction package as a condition of approval. <br /> <br />Mr. Pavan noted that the Commission directed staff to examine access from Bernal <br />A venue. The Public Works Department determined that because of congestion, it would <br />be unsafe and unsuitable. Staff could not support that item. <br /> <br />Mr. Pavan noted that with respect to green building standards, the project had 19 points <br />on the LEED scale, which was short of the certified level. He noted that by the nature of <br />the use, service stations could not achieve a certified level. He noted that the applicant <br />would provide HardiPlank siding made of recycled wood, metal framing consisting of <br />50% to 75% recycled metal. The applicant would also provide the means by which <br />photovoltaics may be applied to the building. <br /> <br />Mr. Pavan stated that staff performed a 1,000-foot notice of the project, and received <br />letters in support. He added that he had received one call of concern from Mr. Craig <br />Moore, 1693 East Gate Way, regarding the sale of beer and wine, and potential noise <br />from the carwash. He noted that Mr. Moore was present at the meeting. <br /> <br />Staff would like to change four recommendations: <br /> <br />1. The fence height between the drive-through lane and the property line is <br />currently three feet and staff would like to increase it to 54 inches.
